However, any claim that the criminal justice system is based on race is met with skepticism on the right. The term “systemic racism,” which is frequently misinterpreted as implying that everyone in the system is racist, is of significant consideration to some on the right. Systemic racism is almost the reverse of racism. It implies that we have systems and organizations that yield racially uneven consequences irrespective of those who work within them. This refers to the fact that much of the criminal justice system was created, honed, and deeply rooted during the Jim Crow era an era that almost everyone, conservatives included, will admit was rife with racial prejudice. The current criminal justice system was instrumental in maintaining racial order by keeping black people in their position.
